Terms of Service

1. Acceptance
By accessing Regulars, creating an account, or claiming a room, you accept these Terms. A person creating a room account confirms that they are authorized to act for that room.
2. The service
Regulars provides a diner discovery and recognition app and web tools for rooms. The service may include confirmed arrivals, visit history, service notes, Regulars Pricing, and guest-relationship indicators. Regulars does not replace the room’s point-of-sale or reservation system.
3. Pricing and leaving
The operator service is $0 through December 31, 2028. After that, the standard model is a flat $59 per month, never per cover. Nothing is charged without explicit opt-in. A room may close its account anytime, with no fee, penalty, or notice period.
4. Ledger export
The room may export its room-scoped ledger—visit history, house-authored notes, and Regulars Pricing application history—anytime while active and for 30 days after account closure. The export may be regenerated during that window and reflects diner account deletions up to the moment it is generated. It excludes diner contact details, diners’ private content, friend activity, and data from other rooms.
Permitted use
Exported data may be used solely for continuity of the room’s own guest relations. It may not be sold, transferred, or used to add diners to marketing lists they did not join through the room directly.
Room responsibility
Once exported, the room holds its copy as its own responsibility under applicable privacy law, including Québec’s Law 25. Deletion requests a diner makes directly to the room regarding the exported copy are the room’s to honour.
5. Staff notes
House notes are limited to facts of service and service preferences. Notes recording health, religious, sexual-orientation, or other sensitive personal information are prohibited. Regulars may remove notes that violate this rule.
6. Closure and retention
Staff access ends when the account closes. The export link remains usable for 30 days. After that window, Regulars deletes the room’s tenant data within 90 days, except records required by law or invoicing.
7. Acceptable use and security
You must protect your credentials, use the service lawfully, and never attempt to access another room’s or diner’s data. You may not disrupt, resell, copy, or misuse the service.
8. Ownership, availability, and liability
Regulars retains rights in its software, brand, and interfaces; the room retains its content. The service is provided as available. To the extent permitted by law, Regulars is not liable for indirect or consequential loss. Nothing limits a right that cannot lawfully be waived.
9. Governing law
These Terms are governed by the laws of Québec and the applicable laws of Canada. The competent courts in the judicial district of Montréal have jurisdiction, subject to mandatory rights.
